These Terms of Service (“Terms”) govern your access to and use of the ApexOne Asia website, and your participation in our training programmes, corporate and in-house engagements, conferences and events. By using our website, submitting an enquiry, or registering for any programme or event, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
ApexOne provides professional training, capability development, and industry conferences. Programme content, schedules, trainers, speakers, venues and dates are indicative and may change. We will make reasonable efforts to deliver Services as described, but reserve the right to make changes where necessary.
Registrations are confirmed only once we have received a completed registration and, where applicable, payment or an approved HRD Corp grant. You are responsible for ensuring that the information you provide is accurate and complete. Places may be limited and are allocated on a first-confirmed basis. Conference passes and delegate badges are issued to a named individual and are non-transferable except as permitted under Section 6.
Fees for each programme or event are stated at the point of registration. Unless stated otherwise, fees are quoted in Malaysian Ringgit (MYR) and are exclusive of any applicable taxes (including Sales and Service Tax), which will be added where required.
Full payment is due within fourteen (14) days of the invoice date, and in any event no later than five (5) working days before the programme or event start date, whichever is earlier. For registrations made within five (5) working days of the start date, full payment is required at the time of registration to confirm your place. We reserve the right to release an unconfirmed or unpaid place if payment is not received by the due date.
Many of our programmes are HRD Corp claimable. Where you intend to claim under HRD Corp (including SBL-Khas), your grant application must be submitted to and approved by HRD Corp before the programme start date. You remain responsible for submitting the correct application and supporting documents and for complying with HRD Corp requirements. Approval of any claim is at the sole discretion of HRD Corp, and non-approval or late approval does not release you from your payment obligations to us unless expressly agreed in writing.
All cancellations must be made in writing to contact@apexone.asia. The following terms apply unless stated otherwise for a specific programme or event:
For multi-day conferences and events, delegate passes are non-refundable within 30 days of the event; however, a substitute delegate may attend in your place at no additional charge with prior written notice.
We reserve the right to reschedule, modify or cancel a programme or event, or to change trainers, speakers, content or venue, where reasonably necessary. If we cancel a programme, you will be offered a transfer to an alternative date or a credit or refund of fees paid for that programme. We are not liable for any incidental costs you may incur (such as travel or accommodation).
Our conferences and events are held primarily in Malaysia and bring together senior leaders, policymakers, practitioners and partners. To keep them safe, professional and welcoming for everyone, all attendees, speakers, sponsors, exhibitors and staff agree to the following Code of Conduct.
All participants are expected to conduct themselves professionally and to treat others with courtesy and respect at all times, including in sessions, networking functions, exhibition areas and social events.
We do not tolerate harassment, intimidation, bullying or discrimination of any kind — including on the basis of race, religion, nationality, gender, age, disability or any other characteristic. This includes offensive comments, unwelcome attention, and inappropriate physical or verbal conduct.
Events are subject to the laws of Malaysia. Participants must comply with all applicable laws and respect local customs and cultural sensitivities. Illegal drugs and any unlawful conduct are strictly prohibited. Attendees who are visitors to Malaysia are responsible for holding valid travel documents and any required passes.
Participants must follow the instructions of ApexOne staff and venue management, observe all health and safety and emergency procedures, and comply with the rules of the host venue. Please familiarise yourself with emergency exits and assembly points on arrival.
Unless stated otherwise for a specific function, the dress code is business or smart business attire appropriate to a professional industry conference.
ApexOne and its appointed media may photograph, film and record the event (see our Privacy Policy). Participants may not record, photograph or livestream sessions, presentations or delegates for commercial purposes without prior written permission. Where a session is designated as operating under the Chatham House Rule or as confidential, participants must not attribute or share what is said outside the session.
Presentation materials, slides and content remain the property of their authors and ApexOne. They may not be reproduced or distributed without permission.
Networking is encouraged, but aggressive selling, unsolicited distribution of marketing materials, and canvassing of other delegates are not permitted unless you are an approved sponsor or exhibitor acting within your designated area. Sponsors and exhibitors must operate within the scope of their agreement with us.
Participants must not offer, give, solicit or accept any bribe or improper advantage in connection with the event, consistent with the Malaysian Anti-Corruption Commission Act and applicable anti-corruption laws.
Where alcohol is served at a social function, participants are expected to drink responsibly and to continue to observe this Code of Conduct.
Delegate badges must be worn at all times and are non-transferable. Access to sessions, functions and restricted areas is limited to the registration type held.
If you experience or witness a breach of this Code of Conduct, please report it to ApexOne staff or email contact@apexone.asia. We may take any action we consider appropriate, including issuing a warning or removing an attendee from the event without refund, and where necessary involving the venue or authorities.
All content on our website and in our programmes — including text, graphics, logos, the ApexOne name and mark, course materials and designs — is owned by or licensed to Ezra & Macquarie Sdn Bhd and is protected by intellectual property laws. You may not copy, reproduce, distribute or create derivative works from our content without our prior written permission. Course and event materials are provided for your personal, non-commercial use only.
You agree not to misuse our website, including by attempting to gain unauthorised access, introducing malicious code, or using it in any unlawful manner or in a way that could damage or impair the site or others' use of it.
Our website and content are provided on an “as is” and “as available” basis. While we take care to ensure information is accurate, we make no warranties or representations as to its completeness, accuracy or suitability for any purpose. Our Services are intended to build capability; we do not guarantee any specific result, certification outcome or business outcome.
To the fullest extent permitted by law, ApexOne and Ezra & Macquarie Sdn Bhd shall not be liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of our website or Services. Our total aggregate liability in connection with any programme or event shall not exceed the fees paid by you for that programme or event.
You agree to indemnify and hold harmless ApexOne and Ezra & Macquarie Sdn Bhd against any claims, losses, liabilities and expenses arising from your breach of these Terms or the Code of Conduct, or from your unlawful or negligent acts or omissions.
We are not liable for any failure or delay in performing our obligations where this is caused by events beyond our reasonable control, including acts of God, natural disasters, epidemics or pandemics, government action, civil unrest, strikes, failure of utilities or venues, or other force majeure events. In such cases we will make reasonable efforts to reschedule or offer a credit.
Your use of our website and Services is also governed by our Privacy Policy, which forms part of these Terms.
These Terms are governed by and construed in accordance with the laws of Malaysia. You agree to submit to the exclusive jurisdiction of the courts of Malaysia in respect of any dispute arising out of or in connection with these Terms.
